1. Acceptance

By using Play Spotter, you agree to these Terms.

2. Intended Use

This app is designed for adult users only. You agree to use the app lawfully, provide accurate information, and not misuse the platform.

3. Crowdsourced Information

Content is user-generated or third-party supplied. We do not verify all listings. We make no guarantees regarding accuracy, safety, availability, or suitability. Use of information is at your own risk.

4. Location Usage

By enabling location services, you consent to its use for local search results, nearby recommendations, and relevant advertising. You may disable location access at any time.

5. Limitation of Liability & Indemnification

To the fullest extent permitted by law, we are not liable for injuries or damages from visiting locations, inaccurate or outdated information, or business practices of listed or advertised entities. Use of the app is at your own risk.

Further, the User agrees to indemnify and hold Play Spotter and its officers, directors, employees and agents harmless from any and all claims, damages, liabilities, and costs (including reasonable legal and accounting fees) related to (a) your access or use of our services or third-party services, (b) your violation of these terms, or (c) your negligence or willful misconduct. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM USE OF PLAYBOUND SHALL NOT EXCEED THE AMOUNT YOU PAID FOR YOUR CURRENT SUBSCRIPTION PERIOD AT THE TIME OF DISPUTE OR CLAIM.

Any action, regardless of form, arising out of or relating to a dispute may be brought by either party not more than one (1) year after the cause of action has accrued.

Governing Law

This Agreement shall be governed by and construed in accordance with he laws of the State of Nebraska, USA. Any legal proceedings shall be filed in Douglas County, Nebraska.

6. Advertising

Ads are paid placements and require approval before being shown. Payment does not guarantee performance. We may reject or remove ads at our discretion.

7. Payments

Payments are handled by third-party processors (Stripe). Refunds are governed by our Advertiser Agreement and refund policy. Once an advertisement has gone live, cancelling a campaign does not entitle you to a refund for time already paid for.

8. Content Standards

You may not submit false or misleading information, unsafe or inappropriate content, or illegal content. We may remove content at our discretion.

9. Intellectual Property

The app and its design are owned by Lucht Applications LLC. Users retain ownership of their content but grant us a license to display submitted content within the app.

10. Termination

We may suspend or terminate access for violations of these terms.

11. User-Generated Content & Moderation

Users may submit content including listings, photos, and reviews. We reserve the right to review, moderate, remove, or restrict any content that is inaccurate, misleading, unsafe, violates our content standards, or is reported by users.

13. Data Sources & Automated Systems

Some location/place data in the app is provided by Google Maps Platform services. Some features use automated systems (including AI) for tasks like ranking, validation, and moderation support. Automated outputs may be imperfect and may be reviewed or overridden by humans.
